1. Acceptance of Terms

Welcome to ecoTriver! By accessing or using our platform, mobile application, or services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and ecoTriver. We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Service Description

ecoTriver is an eco-friendly ride-sharing platform that connects users traveling to music events, festivals, and concerts. Our Service includes:

• Ride Sharing: Drivers can offer rides to events; passengers can book available seats
• Event Discovery: Browse concerts, festivals, and music events with detailed information
• Artist & Venue Information: Explore artist profiles, venue details, and event lineups
• Location Services: Interactive maps, route planning, and distance calculations
• Weather Forecasts: Real-time weather predictions for upcoming events
• Accommodation Search: Find nearby hotels and lodging through integrated widgets
• Messaging: Communicate with other users about rides and logistics
• Impact Tracking: Monitor your environmental impact and carbon savings
• Payment Processing: Secure transactions for ride-sharing cost contributions

ecoTriver is a platform that facilitates connections between users. We are not a transportation provider, and we do not employ drivers or own vehicles.

3. Eligibility & Account Registration

3.1 Age Requirement

You must be at least 18 years old to use ecoTriver. By creating an account, you represent that you meet this age requirement.

3.2 Account Accuracy

You agree to provide accurate, current, and complete information during registration and to update this information as needed. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of unauthorized account access

3.3 One Account Per Person

Each user may maintain only one account. Creating multiple accounts may result in suspension or termination.

4. Platform as Intermediary

ecoTriver is a ride-sharing marketplace. We connect drivers and passengers who wish to travel together to events. We are not a transportation provider, carrier, or mobility service operator. All rides are arranged directly between users. We facilitate the connection and provide the platform infrastructure — we are not a party to any ride, nor do we employ drivers or own vehicles.

The contract for each ride — including any cost-sharing arrangement — is formed exclusively between driver and passenger. ecoTriver bears no responsibility for the performance, safety, or outcome of any ride.

5. Driver Requirements & Responsibilities

5.1 Legal Requirements

If you offer rides as a driver, you must:

• Possess a valid driver's license for the applicable jurisdiction
• Maintain valid vehicle registration and inspection (where required)
• Hold appropriate vehicle insurance coverage as required by law
• Comply with all traffic laws and regulations
• Ensure your vehicle is roadworthy and safe

5.2 Driver Conduct

Drivers must:

• Provide accurate information about their vehicle, route, and availability
• Honor confirmed bookings unless unforeseen circumstances arise
• Treat passengers with respect and courtesy
• Not drive under the influence of alcohol or drugs
• Not use mobile devices while driving (except hands-free for navigation)

5.3 Cost Sharing Limitations

Drivers may request cost contributions from passengers for fuel and tolls, but may NOT operate as a commercial transportation service. Cost sharing must be reasonable and not exceed actual expenses. ecoTriver is for peer-to-peer ride sharing, not commercial taxi or ride-hailing services.

6. Passenger Responsibilities

As a passenger, you agree to:

• Provide accurate pickup location and contact information
• Be punctual and ready at the agreed pickup time and location
• Treat drivers and other passengers with respect
• Honor confirmed bookings or cancel with reasonable notice
• Pay agreed-upon cost contributions promptly
• Follow the driver's reasonable requests (e.g., no smoking, seatbelt use)
• Not bring prohibited items (weapons, illegal substances, etc.)

7. Location Data & Geographic Services

ecoTriver uses geographic location data to provide core functionality:

• Ride Matching: We use your city and pickup/dropoff locations to match you with nearby rides
• Distance Calculations: Route distances are calculated to estimate travel time and costs
• Maps: We display interactive maps using OpenStreetMap/Leaflet to visualize event locations and routes
• Event Discovery: Location data helps you find events and venues near you

By using location-based features, you consent to the collection and processing of geographic data as described in our Privacy Policy. You can manage location permissions through your device settings and profile preferences.

8. Payments & Fees

8.1 Payment Processing

Payments are processed securely through Stripe, our third-party payment provider. By using our payment features, you agree to Stripe's terms and conditions.

8.2 Cost Contributions

Passenger contributions to drivers are for cost sharing only (fuel, tolls, parking). Drivers are prohibited from profiting from rides. ecoTriver may charge a small service fee to facilitate payments.

8.3 Refunds

Refund eligibility depends on cancellation timing and circumstances:

• Cancellations more than 48 hours before departure: Full refund
• Cancellations 24-48 hours before: 50% refund
• Cancellations less than 24 hours: No refund (at driver's discretion)
• Driver cancellations: Full refund to passengers

8.4 Disputes

Payment disputes should be reported to support@ecotriver.com within 7 days. We will investigate and mediate, but final resolution may require mutual agreement between parties.

9. Prohibited Conduct

You may NOT:

• Use the Service for illegal purposes or to violate any laws
• Harass, abuse, threaten, or discriminate against other users
• Provide false or misleading information
• Operate a commercial transportation service through ecoTriver
• Scrape, copy, or harvest data from the platform
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to accounts or systems
• Share your account credentials with others
• Post spam, viruses, or malicious content
• Violate intellectual property rights

10. Intellectual Property

All content on ecoTriver, including text, graphics, logos, icons, images, software, and the compilation thereof (the "Content"), is the property of ecoTriver or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works, publicly display, or exploit any Content without our express written permission, except as necessary for normal use of the Service.

Artist images, event data, and venue information may be sourced from third-party APIs (Spotify, Ticketmaster) and are subject to their respective licenses and terms.

11. Disclaimers & Limitation of Liability

11.1 Platform Nature

ecoTriver is a PLATFORM that connects users. We do not:

• Provide transportation services
• Employ or control drivers
• Own, inspect, or maintain vehicles
• Guarantee the safety, quality, or legality of rides
• Verify user credentials, licenses, or insurance (though we encourage compliance)

11.2 "AS IS" Provision

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ECOTRIVER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING FROM OR RELATED TO:

• Accidents, injuries, property damage, or death during rides
• Actions or omissions of other users
• Loss or theft of personal belongings
• Cancellations, delays, or no-shows
• Service interruptions or technical errors
• Reliance on weather forecasts, maps, or event information

Our total liability in any matter arising from your use of the Service is limited to the amount you paid to ecoTriver in the 12 months preceding the claim, or €100, whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless ecoTriver, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any laws or third-party rights
• Rides you offer or participate in as a driver or passenger
• Content you post or submit

13. Privacy & Data Protection

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Service, you consent to our data practices as described in the Privacy Policy.

14. Environmental Data & Climate Reporting

As part of using ecoTriver, anonymized, aggregated data from rides may be used for the following purposes. This is a standard condition of using the platform and is part of ecoTriver's core environmental mission.

• Academic climate research: Aggregated mobility and CO₂ data shared with climate science institutions and universities studying sustainable event travel.
• Corporate sustainability reporting: Aggregated CO₂ impact data provided to event organizers and corporate partners for verifiable Scope 3 emission reporting. This is part of how ecoTriver makes sustainability measurable and auditable for organizations that use it to meet EU and international reporting standards.

This data is not personal data. All shared data is aggregated at event level (minimum 5 rides per data point) and contains no names, email addresses, home addresses, or GPS traces. It cannot be linked back to any individual user. Because it is genuinely anonymous, it falls outside the scope of the GDPR (Recital 26).

By using ecoTriver, your rides contribute to a real, verifiable picture of how collective travel choices reduce carbon emissions — without exposing anything about you personally. This is fundamental to what ecoTriver is built to do.

15. Right of Withdrawal (Widerrufsrecht)

If you are a consumer within the European Union, you have the right to withdraw from this contract within 14 days without giving a reason, pursuant to § 355 BGB and Directive 2011/83/EU. The withdrawal period begins upon conclusion of the contract (account creation).

Exception: The right of withdrawal lapses once you have actively used a confirmed ride booking, as service performance has begun with your explicit prior request (§ 356(4) BGB).

16. Termination

16.1 Termination by You

You may terminate your account at any time by visiting your account settings or by contacting us at support@ecotriver.com. See our Data Deletion Instructions for information about deleting your data.

16.2 Termination by Us

We may suspend or terminate your account immediately, without notice, if you:

• Violate these Terms or our policies
• Engage in fraudulent, abusive, or illegal behavior
• Create risk or legal exposure for ecoTriver or other users
• Receive repeated complaints from other users

16.3 Effects of Termination

Upon termination, your right to use the Service ceases immediately. Provisions regarding disclaimers, limitation of liability, indemnification, and dispute resolution survive termination.

17. Dispute Resolution

17.1 Informal Resolution

If you have a dispute with ecoTriver, please contact us at support@ecotriver.com to attempt informal resolution before pursuing formal action.

17.2 Online Dispute Resolution (ODR)

Pursuant to § 36 VSBG (Verbraucherstreitbeilegungsgesetz), we are required to inform you that the European Commission provides an online platform for dispute resolution between consumers and traders. This platform is available at: https://ec.europa.eu/consumers/odr. We are prepared to participate in dispute resolution proceedings before a recognized consumer arbitration board.

17.3 Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. Mandatory consumer protection provisions of the country in which you reside remain unaffected.

17.4 Jurisdiction

Any legal action related to these Terms must be brought in the courts of Berlin, Germany. For consumers, this applies only where permitted by applicable mandatory law.

18. Miscellaneous

18.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ecoTriver regarding the Service.

18.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

18.3 No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

18.4 Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms without restriction.
